These Terms and Conditions provide the terms and conditions for access or usage of the [Tap2Health] website {“the Website”} or the application [Tap2Health] {“the App”}.
Introduction
Telemedicine is the use of electronic communications technology to enable health care providers to provide long-distance / remote patient and clinician contact, care, advice, reminders, education, intervention and monitoring in order to improve patient care. Service providers may include third party primary care practitioners, specialists, subspecialists and/or other healthcare professionals (collectively, the “Healthcare Professionals”).
Upon the creation of your account, you agree, confirm and represent that all information that you provide to us at all times, including during the registration process, and any additional information you upload to the Website and/or the App will be true, accurate, current, and complete. You are responsible for maintaining the confidentiality of your account including your password, and you are responsible for all activities that occur under your account. In the event we should discover that any information provided to us is false or inaccurate in any manner, we reserve the right to suspend your account and/or to terminate your account with us.
You will be subject to the rules, guidelines, policies and procedures, terms and conditions as may apply to any product or service provided through the Website or the App. Using any of the products or services shall be taken to mean that you have consented to and agreed to be bound by these Terms and Conditions, as may be amended from time to time. You also agree to bound by the Privacy Policy which may similarly be amended from time to time.
You may not use another person’s NRIC/Passport number to register an account. The same NRIC/Passport number will be printed on MCs and e-prescriptions.
Individuals below the age of 18 may create an account with us but will require a parent or guardian to be present and/or to have provided their written consent, in order to utilise the services provided.
By utilising the Website and/or the App, you agree and acknowledge that while we will use our best endeavours to verify the credentials and qualifications of the Healthcare Professionals, we make no representations or warranties of any kind whatsoever, on the fitness for purpose, quality, adequacy or validity of any advice provided by the Healthcare Professionals. You are advised to seek the necessary independent advice before purchasing any product or service and/or engaging the services of the Healthcare Professionals on the Website and/or the App.
In the event you should use the Website and/or the App for any payable product or service, you will be required to make the necessary payment as stated on the Website and/or the App at the relevant time.
ii. Virtual Consultations
Virtual consultations will be the main form of communication between patients and healthcare professionals for telemedicine services, leading to your e-prescriptions and MCs where necessary for your recovery process.
Virtual consultations may be used for :
• Clearing up concerns regarding new symptoms and minor ailments.
o Examples include but are not limited to: coughs, colds, migraines, sore throat, muscle aches and menstrual issues.
• Requesting for additional advice on management of chronic conditions.
• Seeking a second opinion of certain diagnosed conditions
Virtual consultations may not be used for :
• MC extensions
• Physical Examinations
• Work Injury Compensation
• Eye pain and foreign bodies in the eye
• Ingestion of foreign bodies
• Any other Emergencies
• Consultation on behalf of any other party aside from the Member whose account has been created with us
Once an appointment for a Virtual Consultation is made and is confirmed, no amount shall be refunded if you should initiate a cancellation.
iii. Internet Connectivity
To ensure a smooth virtual consultation session with your selected medical professional, we recommend a minimum requirement of a 4G cellular connection or a strong and stable Wi-Fi connection.
If you are unable to meet the minimum internet connectivity requirement, this may result in an inability to connect to the selected healthcare provider and/or to interrupted services leading to unsatisfactory sessions.
iv. Personal Information
The information required for diagnosis, referrals, and or follow-ups may include any of the following:
· Patient medical records
· Medical images
· Live two-way audio and video feeds
· Output data from medical devices and sound and video files
By registering with us, and/or accessing your account and engaging in a telemedicine consultation, you agree to allow where necessary in the course of your virtual consultation, e-prescription or billing, for Tap2Health, its service providers and other relevant parties to access your medical information.
v. Receiving E-Prescriptions
Please allow your medical professional some time to complete the documentation needed before issuing your e-prescriptions. The processing time is estimated to take between 10 minutes to 15 minutes before your e-prescription appears on your application.
In the event you decide to procure the medication pursuant to the e-prescription, no amount shall be refunded if you initiate a cancellation.
vi. Opting for Delivery
When opting for delivery of your e-prescription, an additional delivery fee may be charged for the delivery of your medication, depending on the selected pharmacy.
The applicable prices of the medication, will be dependent on the prices set by our partner pharmacies, and as stated within our application.
1. Certain conditions such as weather, road conditions and blockages may prevent or delay your medications from its intended delivery, of which we will inform you of the next step.
2. The courier will contact you by phone to facilitate the delivery.
3. You will be required to show a valid form of ID (NRIC/Passport, Driver’s license, etc) to confirm your identity when receiving the prescription .
vii. Miscellanous
You shall comply with all applicable laws that may apply to, including but not limited to any laws pertaining to payment, when using the Website and/or the App.
You understand and agree that the Website and the App, and all products and services provided thereto, are provided on an “as is” basis, without any warranty whatsoever. We are not liable for any third party product or service.
You agree to indemnify, defend and hold TAP2Health harmless including but not limited to its affiliate vendors, agents and employees from and against any and all losses, liabilities, claims, damages, demands, costs and expenses (including legal fees in connection therewith) asserted against or incurred by us that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by you pursuant to these Terms and Conditions.
Your rights under these Terms and Conditions may be terminated without notice if you fail to adhere to and/or breach any of these Terms and Conditions. We may suspend or terminate your access to the Website and/or the App at any time, at our discretion.
These Terms and Conditions are governed by and will be interpreted in accordance with the laws of Malaysia, and the Courts of Malaysia shall have exclusive jurisdiction over any disputes pertaining thereto..
In the event of any inconsistency between these Terms and Conditions and our Privacy Policy, any guidelines or any other related documents, these Terms and Conditions shall prevail.
We reserve the right to amend these Terms and Conditions at any time at our discretion and to notify you of such amendments by posting the amended Terms and Conditions on the Website and/or the App. Your continued use of the Website and/or the App after we post the amended Terms and Conditions shall be deemed to be your agreement to be bound by such amendments.
